Abstract

This paper explores the intricate relationship between intellectual property rights (IPR) and space exploration. While the TRIPS Agreement provides a foundation for IPR protection, its applicability to space activities is complex. The unique challenges posed by space exploration, including enforcement and jurisdiction issues, necessitate a novel legal framework. The Outer Space Treaty and related agreements outline principles for international cooperation and non-appropriation, but their implications for IPR remain unclear. The increasing commercialization of space activities demands a comprehensive legal regime to protect intellectual property rights in this extraterrestrial domain. The paper concludes by emphasizing the need for international collaboration and the development of a tailored legal framework to foster innovation and sustainable space exploration.
