Abstract:
Data protection guards against the loss, alterations, and abuse of sensitive information. In what is sometimes referred to as the “privacy judgement,” the Hon’ble Supreme Court of India upheld the right to privacy as a fundamental right under Article 21 in the 2017 case of Justice K.S. Puttaswamy v. Union of India. “Informational privacy” has been acknowledged as a part of the right to privacy. The court additionally stated that protecting privacy is essential for granting access to both personal and individual information. Several recommendations are being made about data privacy and security, including the contributions of the Bureau of Indian Standards. Since no special legislation has been passed tackling this subject, India’s data protection laws as of right now are found in the Indian Contract Act of 1872 and the Information Technology Act of 2000 (IT Act).
